In the case of Fideldy v. Schumacher, Respondent Rebecca Lynn Fideldy has been employed as a legal secretary for 16 years. Fideldy had been previously employed for ten years at the John Dimich Law Office, where appellant Rose Marie Schumacher was friends with the owner. However, in 2022, Schumacher posted comments on social media about Fideldy, accusing her of inappropriate behavior. As a result, Fideldy petitioned for a Harassment Restraining Order (HRO) against Schumacher, which was granted by the district court. However, a dissenting opinion argues that Schumacher’s comments are protected under the First Amendment as political speech. Despite a brief hearing where Fideldy claimed Schumacher’s allegations were untrue, the district court did not find that the accusations were defamatory.
