Luo v. Wang was decided last week by the Tenth Circuit. Xingfei Luo brought an action against Paul Wang alleging various defamation-related claims. After refusing to participate in discovery and disobeying a judge’s order, the magistrate judge recommended dismissing the action as a sanction. The district court agreed and dismissed the action. Ms. Luo and Mr. Wang began a relationship in 2012, and she moved to the U.S. to be with him in July 2013. Ms. Luo accused Mr. Chen of sexual assault in China, leading to his arrest. The charges were still pending when she moved to the U.S. In 2013, she ended her relationship with Mr. Wang and moved to California. In 2020, she learned of false statements Mr. Wang allegedly made about her. This led to her filing a defamation suit against him. During the course of the case, Ms. Luo disobeyed court orders related to discovery and was ultimately sanctioned by the district court, which dismissed her case. The court found that the dismissal was a reasonable sanction for her discovery violations.
